ENVIRONMENTAL DUE DILLIGENCE
Brownfield development begins with due diligence on all aspects of the project. This phase of the deal process is most critical to ensuring that a successful project will be developed. Environmental due diligence is an important phase of the process and can range from reviewing existing environmental reports and documents relating to the property being acquired, to reviewing new technical documents created by the developer’s consultants to determine if there is proper characterization of all environmental liabilities Quite often due diligence activities to support Brownfield development will be ‘fast tracked’. Typical due diligence periods range from 45 to 90 days. It is during this time period that all data must be reviewed and any additional assessments must take place. As a consequence, JCH reviews project documents on an expedited schedule when necessary in order to provide a written summary of the project as quickly as possible. Options for managing environmental liabilities are presented, including preparing a submittal which will be taken to the insurance markets for engineering and underwriting consideration.
